Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling charges, he was detained in immigration custody.

In her order, the judge pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.
